Description:
This CLE seminar will focus on the legal area of Intellectual Property and its application to the Real Estate industry. After a general introduction regarding the purpose and value of securing intellectual property protection, the seminar will discuss the use and benefits of trademarks, copyrights, patents and related rights in protecting creations and innovations that span the Real Estate arena. Special focus will be placed on the protection of architectural designs including new buildings plans as well as the protection of interior design and furniture creations.
Attention will also be paid to do's and don'ts in avoiding infringement of third parties' proprietary rights. In addition, the area of trade dress will be explored in some detail in terms of its applicability in protecting the "look and feel" of retail and business establishments as well as commercial and residential developments. Finally, the seminar will incorporate the principles of Intellectual Property protection and its concerns into a discussion of the types of agreements, assignments and licenses that may be required in negotiating and completing all types of Real Estate transactions.

Jeffrey M. Kaden and Diana Muller

Jeffrey M. Kaden is a principal and the firm's managing partner. He focuses on patent and trademark prosecution and trademark and copyright litigation. Mr. Kaden has advised a wide range of high-tech and soft goods clients on patent, trademark and copyright procurement in the US and abroad. He earned his JD from Georgetown University Law Center and his B.ES. in Biomedical Engineering from Johns Hopkins University.
Diana Muller is well-known in international trademark and copyright law, worldwide licensing, and in the transfer of technology and security interest agreements. She works with sports marketing firms, sports agents and professional athletes for the protection of the names and likenesses of famous sports figures and entertainers. Ms. Muller earned her JD from the University of Buenos Aires, Argentina and attended a graduate program on International Law at the University of San Francisco. Ms Muller has been the US delegate to the Inter-American Association of Intellectual Property.
